January 1, 2009

Macedonia -- A 38-year-old Peninsula man pleaded not guilty to several misdemeanor charges Dec. 22 after police said the man parked his vehicle over service station underground gasoline tanks, preventing a delivery on Dec. 20.

According to Cuyahoga Falls Municipal Court records, police charged the man with one count each of resisting arrest and improper physical control of a motor vehicle, both first-degree misdemeanors, obstructing official business, a second-degree misdemeanor, and having an open container of alcohol in a motor vehicle, a minor misdemeanor.

Police said an employee of a Highland Road service station reported about 9:20 p.m. Dec. 20 that the man fell asleep inside the vehicle after parking it over the tanks, preventing a gasoline delivery from a waiting truck.

A police officer said he after he knocked on the man's driver's side window, the man moved over to the passenger side.

The officer said he went to the passenger side and tried to talk the man into getting out of the vehicle, but the man refused. Police said they used tools to try to force open the driver's door, but were unsuccessful after the man grabbed one tool that was slid through the side of the door and held down the door lock when the second tool was used.

Police said a third attempt was successful after one officer talked to the man, taking his attention away from two other officers who forced the door open.

Police said the man refused to get out of the vehicle, so they pulled him out and forced him onto the ground. Police said the man struggled before they could get handcuffs on him, resulting in one officer suffering a small cut to his leg.
